SKYJOY FREQUENT FLYER PROGRAM

Introduction

These SkyJoy Frequent Flyer Program terms and conditions (“Terms and Conditions”) govern the SkyJoy Members’ privilege and responsibility of Galaxy Joy Joint Stock Company, the operator of the SkyJoy program, and contain the terms and conditions which are binding on SkyJoy members. By applying to be a SkyJoy member, you agree that you have read, understood, accepted and agreed to be bound by these Terms and Conditions.

These Terms and Conditions shall be applicable and binding on all types of programmes and initiatives under the SkyJoy rewards, including any co-branding arrangements with our respective partners. SkyJoy Frequent Flyer Program (“Program”) is a coalition loyalty program led by Vietjet.

SkyJoy Program is developed and operated by Galaxy Joy Joint Stock Company.

Definitions

Partners” means any companies participating in the Program.

GalaxyJoy” means Galaxy Joy Joint Stock Company – a company incorporated and operating pursuant to the law of Vietnam with the enterprise code 0317355509.

Customers” means any customers.

Frequent Customers” means any frequent customers participating in the Program and becoming a SkyJoy Member as set out in the SkyJoy Membership part.

Vietjet” means Vietjet Aviation Joint Stock Company, a company incorporated and operating pursuant to the laws of Vietnam with the enterprise code 0102325399.

SkyJoy Member” means any customers who qualify the SkyJoy Membership requirements as set out below, and register to become a member participating in the Program.

Application

To be applicable to all companies participating in the Program.

Customers who are entitled to benefits under the Program include: (i) customers of Vietjet and (ii) customers of other companies participating in the Program.

In addition, customers of other companies who do not directly participate in the Program may also enjoy the benefits under the Program where these companies are in cooperation with GalaxyJoy to run their own promotion programs and offer SkyPoint to their customers.

SkyJoy Membership

SkyJoy Membership in the SkyJoy program opens to all individuals all over the world aged 15 years old who meet the terms and conditions to become a SkyJoy member in accordance with the applicable laws. You may register to be a Membership through the online channel or through any other means or channels as determined by GalaxyJoy from time to time.

A SkyJoy Member may request merging of his/her Accounts if a SkyJoy member has multiple Accounts. Prior to the merging of multiple Accounts, GalaxyJoy will perform authentication to verify that the GalaxyJoy member SkyID belongs to the same person. Upon successful authentication, the person needs to choose the principal Account where all the SkyPoint from the other Accounts will be transferred into and merged. Merging of Accounts is final and cannot be reversed. Once merging of Accounts is completed, the SkyJoy member may only redeem and access his/her Account from the principal Account and the other Accounts will be donors that can be used for earning but not for redeeming. SkyPoint which are awarded as a one-time bonus for registering and/or joining the Program, i.e.
welcome point” will not be transferred to the principal Account following the merging of Accounts. Total bonus points for a SkyJoy member under promotion campaigns will also be restricted under each campaign policy once merging of Accounts is completed, i.e. total referral bonus for each SkyJoy member will not exceed the limitation applied for each SkyJoy member in accordance with such campaign policy.

Membership Tier

Customers participating in the program are classified into 4 Membership tiers as follows:

(1) Red Member                    (2) Silver Member                         (3) Titanium Member                     (4) Gold Member

  • Requirements for SkyJoy Membership Tier shall be based on the number of eligible one-way flights for Membership tier, specifically as follows:

  • Provisions on the eligible one-way flights are:
    • Regular commercial flights operated by Vietjet (not applicable to charter flights) including promo fares. In case of a non – direct flight (a flight with 1 stopover and above), the SkyJoy Members ranking system will only recognise it as 01 qualifying flight.
  • Provisions on non- eligible one-way flights:
    • A flight ticket purchased but not used by the Member (No show)
    • A flight redeemed through SkyPoint via SkyJoy website/ mobile application.
    • A flight redeemed through SkyPoint via website/application of Vietjet.
  • Membership Qualifying Date: is the date on which the SkyJoy System evaluates and announces Membership Status Level, which is the 1st (first) day of each month. On this date, the SkyJoy system will automatically rank the Membership level based on the Membership Status Raking Standards.
  • Membership Qualifying Period: is the period for evaluating the Membership Status Level, counting from the Membership Qualifying Date back to 365 days prior to that date.
  • Membership Tier may be ranked not in accordance with the standards set out in these Terms and Conditions subject to GalaxyJoy’s approval.

Membership Status Promotion

  • Members are upgraded to the next level when they meet the number of qualifying flights required on the Membership Qualifying Date.

Membership Status Demotion

  • Members are downgraded at the subsequent Membership Qualifying Date after the expiry date of the period during which Membership benefits are maintained (in case the Members do not meet the requirements on the number of qualifying flights eligible for Membership Tier Ranking).
  • Membership benefits are maintained for a period of 365 days from the date on which the Member meet the requirements on the number of qualifying flights and is upgraded.

Membership Validity

Membership is a lifetime membership program, except for the following circumstances:

  • Silver, Titanium, Gold accounts shall have corresponding validity periods in accordance with the provisions of the Program.
  • The account has been activated and points have been earned but there is no activity for 24 consecutive months;
  • The Account is canceled at the request of the Account holder;
  • The Account is canceled due to the Customer’s wilful use of the Account not in compliance with the Program’s provisions;
  • The Account is closed due to the Customer’s death;
  • Other cases as approved by GalaxyJoy.

Use of member ID and member account

Once a Member receives his/her SkyID, he/she may start to earn SkyPoint at any Partner which has been signed up by GalaxyJoy under the Program for points issuance. The SkyJoy membership and member SkyID is non-transferable and shall only be used by the relevant

Member as a SkyJoy Member.

Each SkyJoy Member shall have a member ID which is the SkyID. SkyJoy Member may use their SkyID to log in to their member accounts.

Products/Services

Products and services from which SkyPoint are earned will be announced by GalaxyJoy to SkyJoy Member and customers from time to time. GalaxyJoy will update SkyJoy Member on the terms and conditions of such new services, offers or programmes at the time of introduction of the services, offers or programmes (if any). The terms and conditions of such new services, offers and programmes are binding on SkyJoy Member as if the same are contained here. For the avoidance of doubt, GalaxyJoy may introduce more than one services or offers or programmes, the terms and conditions of each service, offer or programme that is introduced may apply to the Members at the same time. GalaxyJoy is entitled to introduce and terminate any such service, offer or program at its absolute discretion.

SkyPoint

SkyPoint are points which a SkyJoy Member earns based on the amount of spending which is eligible to earn points according to the terms of the Program. SkyJoy Member shall use SkyPoint to redeem Vietjet flight tickets, receive vouchers for services or physical gifts on the SkyJoy mobile Application according to the redemption policy published on the SkyJoy Website/Application.

  • Validity period of points: Points have no expiry date from the time of issuance.
  • Withdrawal of points: GalaxyJoy shall have the right to withdraw points in the Member’s account in the following circumstances:
    1. The transaction from which points have been earned is refunded/requested for refund;
    2. The account is closed;
    3. There is a mistake in point calculation, point addition due to system errors;
    4. Addition of points from a transaction not in accordance with the provisions on points earning;
    5. Points are earned due to Customer’s violations or wilful frauds.
  • The SkyPoint earning structure varies among various Partners. A list of Partners and the SkyPoint earning structure are available on the SkyJoy website/application and/or the Partners’ website/application.
  • SkyPoint earned will be posted to the Member’s account based on the respective Partner’s own terms and conditions (and the Partner’s stipulated time frame stated in their terms and conditions). This means that the number of days as to when the SkyPoint will be credited and reflected in the Member’s Account will depend on the respective Partner that the Member has earned SkyPoint at. Hence, for avoidance of doubt, the time period for SkyPoint to be credited and reflected in the SkyJoy Members’ Accounts varies from Partner to Partner and will depend on the respective Partner themselves. Accordingly, GalaxyJoy assumes no control, responsibility or liability as to the time period or the award and crediting of SkyPoint from the respective Partners to the SkyJoy Member.
  • Adjustments will be made to SkyPoint accrued in the Member’s Account if there are any credit(s) or debit(s) posted to the Member’s Account, including those arising from returned goods or services. Any disputed transactions/billings will not be credited with SkyPoint. GalaxyJoy reserves the right to change, at any time without prior notice, the number of SkyPoint.

Provisions on Adding Additional Points

Any retrospective claim is strictly subject to the terms and conditions contained herein and Merchant’s terms and conditions. GalaxyJoy shall have the right to make the final decision on adding additional points with respect to any retrospective claim.

A claim for additional SkyPoint is applied:

  • To all Members, including new Members joining the Program.
  • To Members who have used Vietjet’s products and services but have not entered or entered the wrong Member SkyID during the booking process or have not added their Member SkyID before flying.
  • In cases where personal information of a Member is duplicate, resulting in the SkyJoy system’s failure to add points or addition of points to another Member.
  • In cases where the SkyJoy system does not add sufficient points for the Members.
  • Members may claim additional points via SkyJoy mobile Application after 24 hours from the time-of-flight completion. The regulations of additional points only apply for the flight departing from 24 December 2022 and the Member must request a claim for additional points within 90 days from the completion of the flight.

SkyPoint Earn Rate and Structure

SkyJoy Member shall earn SkyPoint based on: (i) their total spending on base fares and ancillary services, excluding taxes and fees collected by the authorities (for Vietjet products/services); and/or (ii) provisions on earning points issued by each Partner.Đối với sản phẩm/dịch vụ của Vietjet:

SkyPoint earning rate is calculated based on the Membership Tier and the type of flight ticket which the Member selects to purchase.

SkyPoint are calculated as follows:

Redemption

SkyPoint may be redeemed through the SkyJoy mobile application and other channels as announced by GalaxyJoy from time to time, which may be: Vietjet’s website and Vietjet’s mobile application and other Partners’ channels (if any).During the redemption process, SkyJoy Member are required to specify the number of points which they want to redeem. SkyJoy Members are allowed to redeem rewards on the basis of deducting the usable accumulated Points in the Member’s account. Points are deducted in the principle of first earned – first deducted.

Conditions for Redemption:

    • Accounts must be in good standing and not canceled, suspended or terminated by us or canceled or deactivated by the SkyJoy member at the time of a redemption request;
    • Request for redemption by the SkyJoy member with insufficient SkyPoint will not be processed;
    • Upon redeeming a deal or reward, the SkyJoy Member release GalaxyJoy from any and all liabilities to the SkyJoy Members in respect of the redemption or use of such deal or reward redeemed under the Program;
    • GalaxyJoy shall not be responsible for any defect or deficiency in the goods or services received as a deal or reward;
    •  Any dispute concerning goods and services received as a deal or reward by a SkyJoy Member by redemption of SkyPoint shall be settled between the Member and the respective service provider, service establishment and/or supplier, which has supplied the goods or services. GalaxyJoy will bear no responsibility for resolving such disputes, or for the dispute itself;
    • Any redemption request made and ordered by the SkyJoy member, once accepted by GalaxyJoy, cannot be revoked, canceled, changed, returned or exchanged by the SkyJoy member. All SkyPoint which have been utilized for redemption will not be credited back into the Account;
    • GalaxyJoy gives no representation or warranty with respect to any type of deals or rewards under the Program, whether flights or products and/or services offered up for redemption. GalaxyJoy gives no warranty with respect to the quality of the products and services offered for redemption or their suitability or fitness for any purpose.

Disclosure of Passwords, Unauthorised Access

GalaxyJoy and SkyJoy Member both play an important role in protecting transactions from online frauds. Members should act with caution to hold information regarding their SkyJoy accounts including SkyID and/or passwords undamaged by ensuring that they shall not knowingly or unintentionally share or provide or create favorable conditions for the unauthorized use of this information. Do not share or allow others to access or use the Members’ SkyID and/or passwords. GalaxyJoy strives to apply the highest security standards to protect the interests of SkyJoy Member. If in any limited event that an unauthorized transaction is conducted using a SkyJoy Member account without any fraud, error or negligence on the part of the SkyJoy Member, GalaxyJoy will understand that the SkyJoy Member will bear the entire direct loss equivalent to the unauthorized transaction.

SkyJoy Member should protect their unique passwords by keeping them confidential. Never write this information down or share it with others. GalaxyJoy will never ask any SkyJoy Member to provide their passwords, which is to ensure that SkyJoy Members are the only ones holding this information. When selecting a password for the first time, a SkyJoy Member should not select the easily identifiable information such as birthdays, phone numbers, or an easily identifiable part of the name of the SkyJoy Member. If a SkyJoy Member discovers that his/her password has been disclosed to a third party, lost or misplaced, and unauthorized transactions may be made, he/she shall be liable for notifying the same to us immediately.

Fees and Charges

Upon redemption of rewards in accordance with the Terms and Conditions of the Program, SkyJoy Members may have to pay fees and charges subject to the type of goods and services which the Member chooses to redeem. Detailed information and fees and charges which Members must pay will be specified under each type of goods and services introduced/provided on the SkyJoy website/application and/or other redemption channels (if applicable).

Transaction History

Transaction history in the form of activities list detailing SkyPoint of the Members shall be available online under the Members’ Account profile on the SkyJoy website/application. The activities list is only accessible by the Members by using their own SkyID, password (and security hint question, where applicable). All entries in the transaction history are deemed true and accurate unless the Member informs GalaxyJoy of any error, exception, dispute or unauthorized transaction within 01 (one) month from the date of the transaction. If GalaxyJoy does not receive any written notification/email from the Member concerning any error in the transaction history within the stipulated time frame, the statement shall be deemed true, complete and accurate, and the Member shall then be deemed to have accepted the entries in the transaction history. For avoidance of doubt, all evidence, information regarding the claims on the transaction history provided to GalaxyJoy by the SkyJoy member shall be only reference and GalaxyJoy at it discretion, as the right to accept/reject such evidences/information to record at GalaxyJoy’s systems.

In the event the investigations and verifications conducted by GalaxyJoy reveal that the disputed transaction(s) (SkyPoint accumulated) were accurate, the Member shall be liable to indemnify GalaxyJoy against all the other costs, expenses & charges which GalaxyJoy may incur in the verification processes of the disputed transactions/SkyPoint accumulated. GalaxyJoy’s findings in any investigation conducted shall be conclusive, final and binding on the Member in any event.

Communication

GalaxyJoy shall be entitled to contact the Members via electronic transmission (including, but not limited to email communication, telex), short messaging services (SMS), or via telephone correspondence, and any other means of exchange communication in respect of, but not limited to, the confirmation of transactions, whether or not the Members transacted the same, status of the SkyJoy membership, the SkyJoy account, SkyPoint, and communication on promotions regarding the SkyPoint. GalaxyJoy shall also be entitled to send the Members offers, promotional and marketing material with regards to the rewards which may be redeemed using SkyPoint from time to time. Any telephone calls placed by GalaxyJoy to the Members will not be deemed as unsolicited calls. In certain cases, GalaxyJoy may record telephone calls between GalaxyJoy and the Members. The Members agree that the monitoring and/or recording may be done without any further notice to the Members or any additional approval from the Members.

By applying to be a SkyJoy Member, you agree for GalaxyJoy to communicate with you in the manner as set out in these Terms and Conditions.

Events of Default

GalaxyJoy may suspend, block, revoke and/or terminate your SkyJoy Membership, your access to the SkyJoy website/application, your participation in the redemption of rewards using SkyPoint, your SkyID and/or any of the services offered (including the forfeiture of accumulated SkyPoint) with or without prior notice upon the occurrence of any or more of the following events, including but not limited to:

    • If you use your SkyJoy Membership and SkyID for any unlawful activities; or
    • If you commit or threaten to commit a breach of any terms and conditions set out in these Terms and Conditions; or
    • If you have furnished false or misleading information or data to GalaxyJoy, including false information concerning your personal information and details; or
    • If your account has been operated or used for fraudulent purposes; or
    • If GalaxyJoy have noticed any irregular, suspicious or unauthorized activity in respect of your account in relation to accumulation of SkyPoint; or
    • If an event or events has or have occurred or a situation exists which should or might in GalaxyJoy’s opinion prejudice your ability to exercise your rights and to perform your obligations; or
    • If GalaxyJoy detects that there has been any fraudulent, abusive or suspicious activity in respect of your account relating to the accumulation of SkyPoint.

In such circumstances, any SkyPoint accumulated in the SkyJoy Member’s account shall be forfeited and GalaxyJoy shall cancel your SkyJoy membership, your SkyID and rewards which you have redeemed by SkyPoint but not in use. GalaxyJoy reserves the right to take any action against the Member as may be deemed necessary or as may be required under governing laws or by the relevant State authorities.

GalaxyJoy reserves all rights to decline or terminate your registration for SkyJoy membership for SkyPoint earning purposes at its sole discretion without any prior notice to you if GalaxyJoy finds that you have furnished false or misleading information to it.

Termination of Accounts

The account of a SkyJoy Member will be terminated in the following circumstances:

    • The Member voluntarily applies for terminating his/her participation in the SkyJoy Program.
    • The Member passes away.
    • The Member’s account has activities and transactions falling under the Events of Default set out above.
    • The Member commits any actions which cause financial, data, image, brand damage to the SkyJoy Program, GalaxyJoy, or the companies participating in the SkyJoy Program, except where there is no fault from the Member.
    • The Member has insulted and assaulted Vietjet employees.
    • The Member commits any actions which threaten aviation security.
    • In any event, when a Member’s account is terminated, all SkyPoint remaining in such an account will be forfeited and cannot be transferred to another Member.

Variation of Terms and Conditions

GalaxyJoy and SkyJoy Member by their registration and use of the SkyJoy accounts shall be deemed that they have agreed to perform all obligations set out in these Terms and Conditions. GalaxyJoy may from time to time vary, revise, add or remove any of the terms and conditions under these Terms and Conditions. The revised terms and conditions will take effect immediately when the same is posted on the SkyJoy website/application and other reward redemption channels (if any) without any prior notice, and if SkyJoy Members continue to conduct transactions through the SkyJoy website/application and other reward redemption channels (if any) after the effective date of the new Terms and Conditions, it shall be deemed as the SkyJoy Members agree with such revisions. Once again, please note that SkyJoy Members are required to regularly update or re-read the Terms and Conditions carefully before conducting any transaction.

Confidentiality

In addition, please refer to SkyJoy’s Privacy Policy regarding the information provided by the Members when they use SkyJoy accounts. The Privacy Policy forms a part of these terms and conditions. By using SkyJoy accounts, SkyJoy Member consent to the processing of SkyJoy Members’ personal information as described in the SkyJoy Privacy Policy which may be amended from time to time.

Costs and Expenses

By accepting these Terms and Conditions, SkyJoy Member agree and undertake to pay all fees arising out of and in connection with rewards, including fees, costs and any types of applicable taxes and charges on a case-by-case basis. GalaxyJoy reserves the right to collect any fees and charges related to the rewards determined/published by GalaxyJoy from time to time, and reserves the right to adjust and change fees (if applicable) of new products/services which may be offered/provided for redemption by GalaxyJoy from time to time. All fees paid in connection with the rewards will not be refunded under any circumstances. Details of applicable fees will be specified on the SkyJoy website/application.

Indemnity

The Members procure that GalaxyJoy shall have no liability for any loss, damage, costs and expenses (in accordance with the laws or otherwise including all costs on a solicitor and client basis) which GalaxyJoy may incur pursuant to the provisions herein or in the enforcement of GalaxyJoy’s rights hereunder.

Service and/or Notification

The Members accept irrevocably consent for documents, materials, product materials, notice or statement provided under these Terms and Conditions to be published on the SkyJoy website/application or announced to the Members by means of communication stated in the Member account registration profile and such documents, materials, product materials, notice or statement shall take effect after 3 days from the date of publication/service.

Any notice or other document to be given under these Terms and Conditions and all other communications by a Member to GalaxyJoy shall be sent via email, delivered directly in writing, or by registered post to GalaxyJoy at the address set out below:

Disclaimers

GalaxyJoy shall not take any liability to the Members for GalaxyJoy’s failure to provide a part or all of the program’s benefits to the Members in the events of force majeure.

GalaxyJoy shall not take any liability in the cases where updated information has not been sent to the Members due to inaccurate contact address or contact address not updated on a timely manner.

GalaxyJoy is exempt from any liability to the Members in the cases where their information is disclosed due to force majeure reasons.

Severability of Provisions

If any of the provisions under these Terms and Conditions is held by any competent authority to be invalid or unenforceable in part or in whole, the validity of other provisions under these Terms and Conditions shall not be affected.

Governing Law

These Terms and Conditions and all issues arising in the contractual relationship between GalaxyJoy and SkyJoy Members will be construed in accordance with and governed by the laws of Vietnam. Any dispute, difference, claim arising out of/or in relation to the provisions of these Terms and Conditions shall be resolved through good faith negotiation within thirty (30) days. If it cannot be resolved within such a period, the above dispute or claim shall be resolved by a competent court.

Notification of Change

The Members must always ensure that they provide GalaxyJoy with their personal particulars and information which is updated in full, accurate and current as at the date of updating. Such information includes the contact address, email address, permanent address, phone number and other required details in order to ensure that the Member’s records with GalaxyJoy are kept up to date, complete and accurate. If for any reason there are any changes to any information provided by a Member to GalaxyJoy during his/her SkyJoy membership, the Member must promptly update his/her Account accordingly (especially with regards to his/her address, email address, phone number). Failure to do so may result in information requested by the Member regarding the redemption of rewards being sent to the wrong person or wrong address. Any notice given by GalaxyJoy shall be deemed to be given to the Member if it is sent by electronic or postal mail to the last known mailing/correspondence address of the Member as shown on the SkyJoy account profile.

PRIVACY POLICY

General Principles:

  1. This privacy policy (“SkyJoy Privacy Policy”) describes how  GalaxyJoy Joint Stock Company (“GalaxyJoy” or “we”) collects, receives, aggregates, stores, uses, processes, discloses, shares and keeps confidential the information of relevant organizations and individuals (“User” or “you”), including customers, agents, suppliers, partners, contractors and service providers who: (i) access, use customer interaction channels owned (or developed/sponsored) by GalaxyJoy, including but not limited to: mobile application,  website SkyJoy.vn, other websites and groups on social networks (such as Facebook, Instagram, Twitter) owned by GalaxyJoy (“SkyJoy Channel”); and/or (ii) use other goods, services, interactive channel provided by GalaxyJoy (items (i), (ii) and (iii) are collectively referred to as “Services“). Please read this SkyJoy Privacy Policy, the relevant terms and other conditions (if any) carefully.
  2. SkyJoy Privacy Policy does not apply to any services, products, websites, or content that are offered by third parties or others that have their own privacy policy.
  3. User Information” means any information, data that can be used to identify the User or upon which the User is identified, such as name, nationality, telephone number, payment card and bank details, personal preferences, email address, location, photo, business registration information, ID card/citizen identity card, date of birth, marital status, insurance information, transactional information, access history, customer journey, locations, position and images of the stores and business operation locations of the User. In addition, some information having sensitive nature such as race, health, religious beliefs, political views, and biometric data may also be collected by GalaxyJoy when necessary.
  4. The User has read, understood, and agreed with the content of SkyJoy Privacy Policy. From time to time, GalaxyJoy may at its discretion amend, supplement, and/or update this SkyJoy Privacy Policy. GalaxyJoy will post the amended, supplemented and/or updated SkyJoy Privacy Policy on SkyJoy application/ website SkyJoy.vn. The User continually uses, accesses to any SkyJoy Channel, or use of the Services constitutes the User’s consent to the content of that amended, supplemented, and/or updated SkyJoy Privacy Policy.
  5. The definitions in this SkyJoy Privacy Policy apply equally to the singular and plural forms of defined terms. The words “include” will be considered to be accompanied by the word “without limitation to”.
  6. SkyJoy Privacy Policy is made bilingual in Vietnamese and English, in the event of any discrepancy between Vietnamese version and English version, the Vietnamese version shall prevail.

I. User Information we collect

We collect User Information during providing Services to you.

The information we collect, and the forms of collection are as follows:

  1. Information you give us: We collect any information you provide us in relation to the Services.
    1. In the following cases, include:

(i) to conduct transactions, accountregistration, log in, interact with SkyJoy Channel, use services and goods provided by GalaxyyJoy;

(ii) to participate in contests, games or events organized by GalaxyJoy;

(iii) to use biometric functions to identify individuals and to authenticate transactions; and/or

(iv) to conduct surveys, investigations, etc

    1. The User is responsible for ensuring that the information provided by the User is complete, accurate and up-to-date to ensure the interests of the User in accordance with the use of the corresponding service. GalaxyJoy will not be held responsible in case the User provides inaccurate or incomplete information pursuant to the relevant terms of Service.

For Users under the age of 15 please ensure to obtain full consent and approval of parents or legal guardians to provide the User Information to GalaxyJoy who shall be bound by this SkyJoy Privacy Policy and are responsible for the behavior of the User under the age of 15 under their legal guardian. GalaxyJoy reserves the right to refuse the User’s access to the SkyJoy Channel or provide related Services if there is evidence that the User whose age is under 15 has not obtained the above consent and approval from his/her parent or legal guardian.

    1. In the event that the User provides the information of a third party, the User represents and warrants that the User has fully obtained such third party’s consent and approval for the User to provide information to GalaxyJoy and for GalaxyJoy to use such information, which will be subject to the terms and conditions in this SkyJoy Privacy Policy.
    1. The User represents and warrants that the information that the User provides to GalaxyJoy will not fall into any of the following types of information:

(i) state secrets,

(ii) business secrets; and

(iii) any other information that the User is not permitted to provide in accordance with the laws or confidential agreements.

2. Automatic Information: We automatically collect certain types of information when the User interacts with the Services.

GalaxyJoy reserves the right to collect information, data related to the activities performed by the User and to other interractions within the Services, including but not limited to information, data about service and good providers for the User, information of transactions performed by the User and your customer via SkyJoy Channels and business location of the User (such as type, specifications, code, images, price and quantity of sold of goods and services and inventory, supporting policies and promotions applied to such goods and services, location, time of transaction), payment method of the User and your customers (excluding important data of payment cards which includes detailed card number, CVV number and other verification numbers with the same legal validity), device information (such as IP address, operating system, browser type, hardware specifications, UDIDs, MEIDs, location, address of referring website (if any), pages visited by the User from SkyJoy Channel and mobile applications, number of visits, responses, file’s name, versions and advertising identities and other relevant information (if any)).

  1. Collection and use of Cookies
    1. GalaxyJoy, and the third parties with whom GalaxyJoy partners may use automated methods, such as cookies, web beacons, advertising identifiers or other automated methods (collectively, “Cookies“) relating to: (i) the use of the SkyJoy Channel or other interactive channels GroupGalaxyJoy; (ii) transaction history of end-user with the User to identify your browser or device, learn more about customer’s preferences, provide the customer with essential features and services; and for other additional purposes. Cookies may contain unique identifiers and are stored on the User’s computer or mobile device, in emails sent by GalaxyJoy, on SkyJoy Channel, other interactive channels of GalaxyJoy Group and in other locations. Cookies may transmit User Information and use of the Services to GalaxyJoy or other entities designated by GalaxyJoy. Cookies are collected for the following purposes:
    1. Identifying you when you log in to use the Services. This allows us to provide you with personalized recommendations, to display personalized content and to provide other customized features and services.
    1. Saving the options, you have approved. This allows us to respect what you like and dislike, such as your language preferences and configuration.
    1. Conducting diagnosis and analysis to improve our services.
    1. Preventing fraud
    1. Improving security.
    1. Providing content, including advertisements, relevant to your interests on our websites and third party websites.
    1. Measuring and analysing the quality of the Services.
    1. Cookies allow you to take advantage of some of our essential features. For example, if you block or reject our Cookies, you will not be able to use certain products or services that require you to log in or you may have to manually adjust a number of options or select the language each time you access SkyJoy Channel again.
    1. Approved third parties may also set Cookies to collect User Information when you interact with the Services. These third parties often include search engines, measurement and analytics service providers, social networks and advertising companies. Third parties use Cookies in the content distribution process, including advertisements related to your interests, to measure the effectiveness of advertising and perform some services on our behalf. Third parties may associate the User Information they collect with other User Information they have about the User from other sources. We do not necessarily have access to or control of the Cookies they use.
    1. GalaxyJoy may share User Information collected via Cookies that are not personally identifiable with Group GalaxyJoy, third parties, such as location data, advertising identifiers or general account identifiers (such as email addresses), to facilitate advertisements display.
    1. You may manage your browser Cookies by adjusting the setting of your browser, blocking or deactivating Cookies, by clearing your browsing history and clearing the cache from your internet browser. You may also restrict our sharing of some of this User Information through your mobile device settings. If you disable all Cookies, neither GalaxyJoy, Group GalaxyJoy nor any third party will be able to transfer Cookies to or from your browser. However, if you do this, you may have to manually adjust some options each time you revisit the Services and some features, channels, and services may not work.
  1. Collection of onsite Information: We collect certain onsite information and images during the User’s use of Services.

We may, by ourselve or by our partners, contractors and service providers, collect certain information and images on the business locations and activities of the User, including but not limited to GPS of the business locations, transportation traffic characteristics and external layout around business locations, signs, design, decoration and layout of business locations, customer density, types of goods and services to be provided and other onsite information and images.

  1. Information from other sources: We may collect User Information from other sources, including service providers, partners, referral programs, when the User adds information of third parties in surveys, investigations, promotions or similar forms and other publicly available sources. When we collect User Information from other sources, we ensure that such data is transmitted to us in compliance with applicable laws.

II. How we store and protect User Information

  1. At SkyJoy, security is our highest priority. Our systems are designed to take into account the security and privacy of your information. All User Information is stored and kept confidential by GalaxyJoy’s system or service provider for GalaxyJoy in accordance with the law and this SkyJoy Privacy Policy.
  1. When collecting and receiving data, GalaxyJoy will exert its best endeavours to the permitted extent to store and protect the User Information on the server system and these User Information will be secured by firewalls system, access control measures, data encryption. GalaxyJoy has appropriate technical and security measures to prevent as much as possible to the permitted extent the unauthorized access and use of User Information. GalaxyJoy also regularly cooperates with security experts to update the latest information on network security to ensure the safety of User Information.
  1. The information of your payment card issued by financial institutions is protected by us according to the principle that no important data of the payment card (card number, CVV number and other verification numbers with the same legal validity) will be stored by our system. Your payment transaction is made via the system of affiliated banks of GalaxyJoy or a partner providing service through SkyJoy Channel.
  1. The User may not use any tools, programs, or methods to illegally interfere with the system or alter the data structure of any Services, nor any other activities to spread, promote activities with the purpose of intervening, sabotaging or infiltrating the GalaxyJoy system’s data, as well as activities violating Vietnamese laws. In case we detect a violation, we reserve the right to transfer information about the violation to the competent authorities in accordance with the law.
  1. The User is responsible for protecting your account information and may not provide any information related to your account, password or authentication methods (eg, OTP) accessed on websites, applications, software, and other tools (if any).
  1. We are not responsible for problems arising when you use the Services from tools, interfaces other than the official websites, applications, software which are allowed to be used for the Services. In addition, the Services may contain links to and from services of partners’ networks, advertising companies, GalaxyJoy Group or their affiliates. Please be noted that each party will have its own privacy policy, and the storage, security and use of information provided to these parties is outside GalaxyJoy’s control. Therefore, GalaxyJoy will not assume any liability or responsibility for the storage, security and use of this information. Please check these parties’ privacy, security or similar policies before sending any personal data to them.
  1. We store User Information to ensure that you are able to use the Services continuously and store it for as long as necessary to fulfill the Purpose, or as otherwise required by law (including for tax and accounting purposes), or to perform other work as notified to you in advance. The period we retain specific User Information varies depending on the Purpose. When the User Information is no longer needed for the provision of the Services or Purpose or GalaxyJoy no longer has a business or legal purpose to retain User Information, we will take steps to prevent the access to or use of User Information for any purpose other than to comply with this SkyJoy Privacy Policy, or for the security, confidentiality, fraud detection and prevention purposes.
  1. User Information may be stored in, accessed from or transmitted to many countries, including Vietnam. When we transfer your User Information to other countries, we will ensure that such information is transferred in accordance with this SkyJoy Privacy Policy and is permitted under the relevant laws.

III. How we use User Information

  1. The User hereby agrees that User Information to be collected in accordance with this SkyJoy Privacy Policies shall be published and otherwise used in accordance with the license User grants to us regarding the Purpose as mentioned in Section 3 below.

  1. To manage, operate, provide and/or administer the User’s usage and activities when you use the Services.
  1. To confirm transactions and process payments;
  1. To propose, acquire, provide or facilitate insurance or financial solutions;
  1. To enable features to personalize the User experience, such as interest identification, list of favorite apps and information of interest, suggesting the Services;
  1. To perform internal operations necessary to provide services, including troubleshooting software failures and operational issues, conducting data analysis, testing and diagnosis, monitoring and analyzing the usage trends and activities;
  1. To protect the security or integrity of the Service and any facilities or equipment used to provide the Services;
  1. To process and manage rewards, awards or incentives;
  1. To enable interactions between Users, between Users and GalaxyJoy or between Users and associated partners; and
  1. To allow GalaxyJoy partners to manage and allocate resources to provide services.
  • Measuring, supporting and improving the Services:
  1. To communicate, support communication with Users, exchange between Users and GalaxyJoy, and handle valid User requests;
  2. To investigate and locate areas of concern;
  3. To monitor and improve responses from GalaxyJoy’s customer support;
  4. To notify the steps taken to resolve customer support issues;
  5. To store, manage, provide for incident recovery or other similar purposes; and
  6. To measure usage, analyze performance, find ways to improve and develop the Service.
  • Researching and developing

To carry out research, analysis, testing and development activities including but not limited to data analysis, surveys, product and service development and/or customer profiling, analyze how Users conduct activities on GalaxyJoy’s platforms, do a market analysis, improve Services to enhance User experience, develop new features, products and services and facilitate financial and insurance solutions and simultaneously protect data, improve and enhance safety, security and confidentiality.

  • Marketing and promotion
    1. To send to the User, by means in accordance with the laws, notices, updates, documents, advertising information, promotions, wishes, invitations, participation management and other documents relating to the Services, GalaxyJoy and its sponsors, partners, sponsors and advertisers of products, services, events or promotions.

    1. GalaxyJoy may contact for marketing purposes by post, phone call, short message service, online messaging service, text notification and email.
    1. You may cancel your subscription to marketing and promotional information by following GalaxyJoy’s instructions from time to time.
  • Compliance with legal obligations: We have a legal obligation to collect, use or store your User Information in certain circumstances, including when required, when consulted, recommended or required by legal advisors or any legal provisions, bylaws, documents or requests of the government or local or foreign authorities, at the request of competent authorities, including without limitation to the obligation to disclose information and reports in accordance with the law on sales promotion, record keeping, audit, investigation and settlement of complaints or disputes, and compliance with court order or legal requirements, documents or requests of the government or other regulations; enforcing T&C or other agreements; and protect our rights or property in the event of a complaint or dispute.
  • Preventing fraud and abuse, risk management:
    1. For the identification and/or verification of User information;
    1. To detect, prevent fraudulent, sabotage activities against User’s account, or tampering with the user’s identity in the Services;
    1. To prevent or investigate any fraud, illegal activity, misconduct or omission related to the use of the Service or any other activity arising out of the relationship between GalaxyJoy and the User in the Services;
    1. To identify deceit, fraud, misconduct or omission of partners and provide personal feedback to partners of GalaxyJoy;
    1. To detect, prevent and prosecute crime; and
    2. To use grading methods to assess and manage risk.
  • Other legal purposes that are consistent with the goals of the Service (if applicable)
  1. For purposes of using User Information that are not mentioned above and/or that require your specific consent, we may obtain your consent to use User Information for such specific purpose when we contact you.

IV. How we share User Information

User Information is an important part of our operations, and we and Group GalaxyJoy do not sell User Information to others. We only share User Information, to the extent necessary, as set out below, in accordance with this SkyJoy Privacy Policy. The parties who are sharing the access to User Information must commit to strictly comply with the provisions of law and related provisions in this SkyJoy Privacy Policy.

  1. Complying at the request of the competent state authority, or as required by law;
  1. Sharing User Information with other Users in the event that Users use interacting tools on SkyJoy;
  1. Providing and sharing User Information with partners at the User’s request or confirmation, including but not limited via means of electronic transaction on SkyJoy Channel or in writing. For example, when a User requests a service through a GalaxyJoy partner (including the use of loan estimator tools, loan pre-approval tools, or contacting a loan advisor) or uses a promotion offered by a GalaxyJoy’s partner, User hereby agrees that GalaxyJoy may share the User’s User Information with those partners. User also agrees that User Information shared with GalaxyJoy’s partners may be transferred to the parties in relation to the Service used by User. GalaxyJoy’s partners include those integrated with the SkyJoy application or the application of GalaxyJoy integrated with the system of partners, transportation and financial service partners or business partners that GalaxyJoy cooperates to provide: promotions, competitive services, or other special services;
  1. Exchanging, providing and sharing User Information with its subsidiaries, affiliates, companies within the corporate group model, branches and other related entities with GalaxyJoy (collectively, “Group GalaxyJoy”);
  1. We and GalaxyJoy Group may provide User Information to suppliers, consultants, marketing partners, research companies and other service providers or business partners. This includes: payment processing and support departments; anti-money laundering service; server providers, information technology service providers, cloud storage providers; advertising partners and advertising platform vendors; data analysis providers; research partners, including those conducting surveys or research projects cooperating with GalaxyJoy or on behalf of GalaxyJoy; insurance, financial and banking partners;
  1. Exchanging, providing, and sharing User Information with third parties who are GalaxyJoy or GalaxyJoy Group’s advisers, experts, agents or service providers, subcontractors: GalaxyJoy and GalaxyJoy Group may transfer User Information to advisors, experts and subcontractors to deploy the work, services suitable for the intended use;
  1. Corporate transfer: In the course of business development, we may sell or buy other businesses or services. In such transactions, User Information is generally one of the transferred business assets but must still comply with the provisions of this SkyJoy Privacy Policy (or otherwise approved by the customer). In addition, in the event that GalaxyJoy or most of GalaxyJoy’s assets are purchased by another company, the User Information will automatically become one of the transferred assets.

V. Access and Choice

  1. You may view, update and delete certain information about your account and interactions with the Services. If you cannot access or update your information yourself, you can always contact us for assistance.
  1. You have several options regarding the collection and use of your User Information. Many Services include functionality that allows you to customize how your information is being used. You may choose not to provide certain information, but then you may not be able to take advantage of certain Services. Please follow Galaxy Joy’s instructions from time to time.

a. Account information: If you want to add, update or delete information related to your account, please follow GalaxyJoy’s instructions from time to time. When you update or delete any information, we usually keep a copy of the previous version

b. Contact: If you do not want to receive promotional messages from us, please unsubscribe or adjust your communication preferences according to GalaxyJoy’s instructions from time to time. If you do not want to receive in-app notifications from us, please adjust your app or device notification settings.

c. Advertistisement: If you do not want to see interest-based advertising, please adjust accordingly pursuant to GalaxyJoy’s instructions from time to time.

d. Browsers and devices: The Help feature on most browsers and devices will tell you how to prevent your browser or device from accepting new Cookies, how to notify your browser when you receive new Cookies or how to disable the Cookies function completely.

VI. Contact information, notices and modifications

GalaxyJoy reserves the right to amend, update or adjust the terms of this SkyJoy Privacy Policy at any time by publishing the updated SkyJoy Privacy Policy on the relevant SkyJoy Channel.
